These Terms and Conditions set out the basis on which Waste Disposal Earls Court provides waste removal, rubbish clearance and related services within Earls Court and surrounding areas. By booking a waste collection or using any of our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
In these Terms and Conditions, the following expressions have the meanings set out below:
1.1 Customer means any individual, business, company, partnership, organisation or other entity that requests or receives services from Waste Disposal Earls Court.
1.2 Services means any waste collection, waste disposal, rubbish removal, recycling, clearance, or related services provided by Waste Disposal Earls Court.
1.3 Booking means a confirmed request by the Customer for Services on a specified date, time and location.
1.4 Waste means any items, materials or substances presented by the Customer for collection, including household waste, commercial waste, bulky items, and recyclables, subject to the exclusions set out in these Terms and Conditions.
1.5 Site means the premises, property or location from which the Waste is to be collected.
1.6 Agreement means the contract between the Customer and Waste Disposal Earls Court comprising these Terms and Conditions and any written confirmation or quotation provided to the Customer.
2.1 Waste Disposal Earls Court provides waste collection and removal services for domestic and commercial Customers in Earls Court and nearby areas. The precise scope of Services will be set out in the booking confirmation or quotation issued to the Customer.
2.2 Unless expressly agreed in writing, the Services are limited to the collection, transport and lawful disposal or recycling of Waste that is acceptable under applicable waste regulations and these Terms and Conditions.
2.3 Waste Disposal Earls Court reserves the right to refuse to collect any Waste that is hazardous, prohibited by law, unsafe to handle, incorrectly described, inadequately packaged or exceeds any weight, volume or access limitations notified to the Customer.
3.1 Customers may request a quotation or place a booking by telephone, email or other communication methods offered by Waste Disposal Earls Court.
3.2 When requesting a booking, the Customer must provide accurate and complete details, including:
a) Full address of the Site and any access restrictions.
b) Type, approximate volume and nature of the Waste.
c) Preferred date and time window for the collection.
d) Contact details for the responsible person on Site.
3.3 Any quotation provided is based on the information supplied by the Customer and is subject to revision if the actual Waste, access conditions or other relevant circumstances differ materially from those described at the time of booking.
3.4 A Booking is only confirmed once Waste Disposal Earls Court has accepted the Customer's request, either in writing or verbally, and has provided a collection date and price estimate. Waste Disposal Earls Court may decline any booking at its sole discretion.
3.5 The Customer is responsible for ensuring that an authorised person is present at the Site at the agreed collection time to grant access, confirm the Waste to be collected and approve any adjustments to the quotation if necessary.
4.1 The Customer must ensure that Waste Disposal Earls Court has safe, reasonable and unobstructed access to the Site during the agreed time window.
4.2 The Customer is responsible for ensuring that:
a) All Waste intended for collection is clearly identified, accessible and not mixed with items that the Customer does not wish to dispose of.
b) Any necessary permissions for access, parking or loading are arranged in advance.
c) The Site is safe for personnel and vehicles, with no known hazards that have not been disclosed.
4.3 If access to the Site is delayed, restricted or unsafe, Waste Disposal Earls Court may at its discretion:
a) Charge a waiting time fee.
b) Charge a missed collection or call-out fee.
c) Rearrange the collection for another time and apply additional charges.
4.4 The Customer warrants that they have the authority of the owner or occupier of the Site to request the removal of the Waste and that disposal of the Waste will not breach any third-party rights.
5.1 Waste Disposal Earls Court will collect general household and commercial waste, bulky items, furniture, appliances (subject to lawful handling requirements) and similar non-hazardous materials.
5.2 The following types of Waste are excluded from standard Services unless specifically agreed and arranged in advance:
a) Hazardous or special waste, including but not limited to asbestos, chemicals, solvents, paints, oils, clinical waste, sharps, gas cylinders, and certain electrical items.
b) Explosive, flammable or otherwise dangerous materials.
c) Liquid waste, including fuel and certain oils.
d) Any Waste that cannot lawfully be transported or disposed of under applicable regulations.
5.3 If prohibited or hazardous Waste is presented for collection without prior agreement, Waste Disposal Earls Court may refuse to remove it and may charge a call-out or additional handling fee.
6.1 Prices for Services are based on factors including volume, weight, type of Waste, labour involved, access conditions and disposal or recycling costs.
6.2 Any price quoted before collection is an estimate only and is subject to confirmation once Waste Disposal Earls Court has inspected the Waste on Site. If the actual Waste differs substantially from the Customer's description, the final price may be adjusted.
6.3 Any additional charges, such as parking fees, congestion or clean air zone charges, waiting time fees or surcharges for difficult access or heavy loads, will be added to the final invoice where applicable.
6.4 Unless otherwise agreed in writing, payment is due immediately on completion of the Services. Waste Disposal Earls Court may require full or partial payment in advance for certain bookings.
6.5 Accepted payment methods will be confirmed at the time of booking and may include cash, card payment or bank transfer. The Customer is responsible for ensuring that cleared funds are available.
6.6 If the Customer fails to make payment on the due date, Waste Disposal Earls Court reserves the right to charge interest on overdue amounts, recover reasonable debt recovery costs, and suspend or cancel any future Services.
7.1 The Customer may cancel or amend a Booking by giving Waste Disposal Earls Court as much notice as reasonably possible.
7.2 If the Customer cancels a Booking with less than 24 hours' notice prior to the agreed collection time, Waste Disposal Earls Court reserves the right to charge a cancellation fee to cover administration and scheduling costs.
7.3 If the Customer is not present at the Site at the agreed time, or if access cannot be obtained due to circumstances within the Customer's control, Waste Disposal Earls Court may treat the Booking as a missed collection and charge a call-out or cancellation fee.
7.4 Waste Disposal Earls Court will use reasonable efforts to attend the Site within the agreed time window but does not guarantee exact arrival times. If unforeseen circumstances, such as traffic conditions, vehicle breakdown or extreme weather, prevent timely attendance, the Customer will be offered an alternative appointment, and no liability will arise for any resulting delay.
8.1 Waste Disposal Earls Court will carry out the Services with reasonable care and skill and in accordance with applicable law and recognised waste management practices in the service area.
8.2 Personnel will remove Waste from the Site as agreed, but Waste Disposal Earls Court is not responsible for general cleaning or remedial works beyond removing the agreed items, unless explicitly included in the Service description.
8.3 Title to the Waste passes to Waste Disposal Earls Court at the point of collection, subject to applicable regulations. Once collected, Waste Disposal Earls Court will manage, transport, recycle or dispose of the Waste in line with legal requirements and environmental obligations.
9.1 The Customer warrants that:
a) All Waste presented for collection is accurately described and does not include prohibited or hazardous materials unless previously agreed.
b) The Waste is owned by the Customer or the Customer has the legal authority to arrange for its removal.
c) The presentation, storage and packaging of the Waste is safe and suitable for handling, loading and transport.
9.2 The Customer agrees to indemnify and keep indemnified Waste Disposal Earls Court against any claims, liabilities, costs, damages or expenses arising from:
a) Any breach of these warranties.
b) The provision of incorrect or misleading information about the Waste.
c) Any third-party claim related to the removal of the Waste from the Site.
10.1 Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.
10.2 Subject to clause 10.1, Waste Disposal Earls Court will not be liable for:
a) Any loss of profits, loss of business, loss of revenue, loss of anticipated savings, or any indirect or consequential loss or damage.
b) Any damage to items that the Customer has not expressly identified as fragile or requiring special handling at the time of booking.
c) Any loss or damage arising from pre-existing defects, weaknesses or conditions at the Site.
10.3 If, despite the preceding provisions, Waste Disposal Earls Court is found liable to the Customer for any loss or damage arising out of or in connection with the Services, such liability shall in all circumstances be limited to the total price paid by the Customer for the relevant Booking.
11.1 Waste Disposal Earls Court operates in accordance with applicable waste management legislation, regulations and duty of care requirements in the United Kingdom.
11.2 Waste will be transported only by appropriately registered carriers and disposed of or recycled at authorised facilities in accordance with environmental legislation and best practice.
11.3 Where legally required, documentation relating to waste transfer or disposal will be completed and retained in line with statutory obligations.
11.4 The Customer agrees to co-operate with any reasonable request for information or documentation necessary for compliance with waste regulations, including accurate descriptions of the Waste and confirmation of its origin.
12.1 If the Customer is dissatisfied with any aspect of the Services, they should notify Waste Disposal Earls Court as soon as reasonably practicable, providing full details of the issue and any supporting information.
12.2 Waste Disposal Earls Court will investigate complaints in good faith and seek to resolve them promptly, which may include reattending the Site where appropriate, offering a partial refund or other reasonable remedy where a fault is acknowledged.
12.3 If a dispute cannot be resolved amicably, either party may pursue its rights through the courts as provided under the governing law clause below.
13.1 Waste Disposal Earls Court will collect and process personal data necessary for the provision of Services, such as contact details, Site address and payment information.
13.2 Personal data will be handled in accordance with applicable data protection laws in the United Kingdom and will not be shared with third parties except where necessary to deliver the Services, comply with legal obligations or with the Customer's consent.
14.1 Waste Disposal Earls Court shall not be liable for any failure or delay in performing its obligations under these Terms and Conditions where such failure or delay results from events, circumstances or causes beyond its reasonable control, including but not limited to severe weather, strikes, lock-outs, transport disruptions, accidents, acts of government or other force majeure events.
14.2 In such circumstances, Waste Disposal Earls Court will use reasonable endeavours to resume Services as soon as reasonably practicable and may reschedule bookings without liability for any resulting inconvenience or loss.
15.1 Waste Disposal Earls Court reserves the right to amend or update these Terms and Conditions from time to time. The latest version will apply to all new bookings.
15.2 Any changes will not affect confirmed Bookings already accepted unless required by law or regulation, in which case reasonable notice will be given where practicable.
16.1 If any provision of these Terms and Conditions is found by any court or competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, lawful and enforceable. If such modification is not possible, the relevant provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.
17.1 These Terms and Conditions, together with any written quotation or booking confirmation, constitute the entire agreement between the Customer and Waste Disposal Earls Court in relation to the Services and supersede any prior understandings or arrangements, whether written or oral.
17.2 The Customer acknowledges that they have not relied on any statement, promise or representation not expressly set out in this Agreement.
18.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of England and Wales.
18.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by Waste Disposal Earls Court.
